Biden’s Moribund Vaccine Mandate: SCOTUS will concur with the 5th Circuit that this arbitrary edict is fatally flawed

The Biden administration will inevitably ask the Supreme Court to review last Friday’s decision by the 5th Circuit Court of Appeals to halt its vaccine mandate. The effort is likely to be futile, however. Writing for the appeals court, Judge Kurt Engelhardt confidently predicted that the mandate’s challengers “are likely to succeed on the merits” under judicial review. Engelhardt took particular exception to the attempt to impose the mandate through the Occupational Safety and Health Administration (OSHA), pointing out that the Constitution’s Commerce Clause and the nondelegation doctrine preclude OSHA from making such “sweeping pronouncements on matters of public health affecting every member of society in the profoundest of ways.”

Federal court UPHOLDS decision to halt Biden’s federal vaccine mandate after blasting edict as ‘staggeringly overbroad’

A federal court has upheld its previous decision to put a hold on President Joe Biden’s COVID vaccine mandate for companies with 100 workers or more.

A three-member panel of the 5th US Circuit Court of Appeals in New Orleans, which covers Texas, Louisiana and parts of Mississippi, affirmed it’s ruling in a new opinion published Friday. 

That saw it order the US Department of Labor to take no further steps to implement its mandate, whose deadline is January 4.

Religious exemptions from vax: “Sincerely Held Religious Beliefs”

Sincerely Held Religious Beliefs

42 U.S. Code § 2000e–2 defines “Unlawful employment practices” as follows:

It shall be an unlawful employment practice for an employer— (1) to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion, sex, or national origin; or (2) to limit, segregate, or classify his employees or applicants for employment in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individual’s race, color, religion, sex, or national origin.

This means that employers must respect your “sincerely held religious beliefs” with regard to the COVID vaccination with a reasonable accommodation. The sincerely held religious belief need only be yours alone, and there is no requirement that such belief be generally accepted theological dogma. 

Written documentation of your sincerely held religious belief is mandatory, as is specifically using the key words “sincerely held religious belief.” Be certain to retain copies of your request and take photos if your employer has an electronic portal system that does not otherwise provide you a written copy. Secure your copy of the request in a safe and readily accessible spot outside of your place of employment.

Texans vote in favor of prohibiting governments from limiting religious services

(RNS) — Texas voters on Tuesday (Nov. 2) overwhelmingly supported a measure barring governments from taking any kind of action that limits religious services, such as the public health orders that shut down houses of worship and businesses earlier in the COVID-19 pandemic.

Proposition 3, which will add a clause to the Texas Constitution forbidding state or local authorities from prohibiting or limiting religious services, garnered 62.4% of votes, according to unofficial results from the Texas secretary of state

The measure had the support of the Texas Catholic Conference of Bishops  and some other — but not all — religious groups.

Longtime Clinton crony takes center stage in latest Durham indictment

An elusive ally of the Clintons was a key figure in Thursday’s indictment Igor Danchenko, the analyst who contributed key information to the now-infamous “Steele Dossier.”

Charles H. Dolan Jr., a former aide to Hillary Clinton, is identified only as “PR-Executive 1” in the indictment, which stemmed from special counsel John Durham’s long-running investigation into the FBI’s probe of Donald Trump’s 2016 presidential campaign and its alleged ties to the Russian government.

Danchenko intentionally misled the FBI when he denied in a 2017 interview that he had spoken to Dolan about any material contained in the file, according to the charging document.

The Igor Danchenko Indictment: It was all a fraud

John Durham has another scalp. On November 3, 2021, Igor Danchenko – Christopher Steele’s primary subsource – was arrested by federal authorities.

Now we have his indictment. Danchenko has been charged with false statements to federal officials during his 2017 interviews with the FBI.

According to the indictment, Danchenko lied about his contacts with “Russians,” his travels to Russia, and the identity of his sources. (Those are just some of the lies.) In John Durham’s words:

Maine passes nation’s 1st ‘right to food’ amendment

PORTLAND, Maine (AP) — Maine voters passed the nation’s first “right to food” constitutional amendment on Tuesday.

A statewide referendum asked voters if they favored an amendment to the Maine Constitution “to declare that all individuals have a natural, inherent and unalienable right to grow, raise, harvest, produce and consume the food of their own choosing for their own nourishment, sustenance, bodily health and well-being.” It was an experiment not tried before by any state.

Senate GOP set to nix WH vax on cos with 100+ employees

More than three dozen Senate Republicans are moving to formally disapprove and nullify President Biden’s vaccine mandate on private employees Wednesday under the Congressional Review Act — the official process for Congress to eliminate an executive branch rule.

Sen. Mike Braun of Indiana is leading 41 Republican senators on Wednesday to “strike down” Biden’s rule, which mandates employees — at private businesses with 100 workers or more — to receive COVID-19 vaccines.

Supreme Court To Hear Major Second Amendment Case

The U.S. Supreme Court is due to hand down a major ruling on American’s Second Amendment rights. The court recently announced it will hear a case soon, which could potentially increase the number of people able to carry a gun in public.

According to gun rights advocates, a favorable ruling by the Supreme Court would make it harder for Democrat-led cities to deprive citizens of the right to carry guns in public.

“We feel that the suit is: One, to bring equal justice and equal protection to the people, the gun owners in New York state,” explained Tom King, President of the New York State Rifle & Pistol Association (NYSRPA). “Two, to show that the Second Amendment applies outside the home and doesn’t stop at your doorstep. And thirdly, to bring us in line with approximately 40 other states that have ‘shall issue’ permits or constitutional carry.”

Covid-19 Vaccine Manufacturers Can Harm You With Near Complete Impunity: The government axes your job but shields pharma companies from financial liability for injuries. Who does the government work for?

Imagine that in order to keep your job, the government requires you to take a pill that only protects you, and not others, and if you are harmed by that pill, you can’t sue the company that makes and sells the pill.  Seems dystopian?  Well, it is.  But it is exactly what is occurring with Covid-19 vaccines.

The lesson yet again is that civil and individual rights should never be contingent upon a medical procedure.  Never.  It is the last and final backstop to the dangerous authoritarianism that results when we permit the government to decide what must be injected or placed into or onto our bodies.   Whatever your views are on the Covid-19 vaccine itself, every American should reject letting the government decide what medical procedures they must engage in to have a job.
