The jury convicted her of disorderly conduct related to her verbal altercation with Sharmake Omar, the bystander who filmed the viral incident, but acquitted her of the charge involving the 8-year-old boy with autism who had taken an applesauce pouch from her bag.
Sentencing imposed a $1,000 fine, 200 hours of community service, and one year of supervised probation. The 90-day jail sentence was stayed, meaning she will not serve jail time provided she complies with the probation terms.
Defense attorney Brian Karalus vowed to appeal the decision, arguing that the prosecution infringed on First Amendment rights and alleging misconduct by the judge and perjury by the victim’s father, Shire Jimali. NAACP President Walé Elegbede described the verdict as a “mixed result,” noting that while accountability was achieved, the acquittal on the charge involving the child was disappointing.
He harassed her. She answered back in a most reasonable fashion. She was not the instigator. She only did as he asked. Following that, she gave him the finger, which he richly deserved. If you do not respond to a threat such as he made against her, your assailant too often will escalate, based on their assessment of your weakness. He baited Shiloh and left her no real choice. If he had approached her and she had shot him, it would have been justified self-defense. I doubt this will be the end. Ridiculous sign of our times. ABN
